That can be argued actually to be more a regional, or traditional thing not a religious dogma as the Qu'ran simply states that both men and women should follow morality that is they should present themselves, and their actions in a moral manner, again not much is specified, and implied when it comes to the burkha or the veil, and even then they are not obligated or forced, but it it recommended mostly according to tradition in my opinion.

The Shari'ah is not singular, nor monolith, it is not an instiution concerning the whole Islamic world. There are regional differences, and when implied correctly in most cases the Shari'ah was there to implement freedoms afforded to women, to implement a legal law code, etc.
